
Term Of Use
Untitled document This agreement sets out the terms and conditions (‘Terms and Conditions’) applicable to members of the service operated by OwnersConcierge (Owners Concierge, LLC). By using the OwnersConcierge.com website (“Site”) you agree to follow and be bound by these terms of use (the “Terms of Use”) and agree to comply with applicable laws and regulations. It is your responsibility to review these Terms of Use periodically.
If you do not agree with these Terms of Use you must not continue.
Applicants (referred to as ‘members’) must agree to the following Terms and Conditions. In the event a member breaches or otherwise fails to comply with any provision of these Terms and Conditions then in addition to any other remedy available to OwnersConcierge, OwnersConcierge may terminate the participation of such member in the service and/or may withhold any payments relating to participation in the service due to such member from OwnersConcierge.
Eligibility Requirements
OwnersConcierge.com shall have absolute discretion as to whether or not it accepts a particular applicant or property for participation in the service.
Removal from Network
OwnersConcierge.com reserves the right to terminate the participation of any member without reason but expressly including any member that OwnersConcierge judges to be in violation of the Terms and Conditions.
Refer-a-Friend
Referred customers must mention referring customer at time of initial access to premium account areas and tools. Referring customer must be a current Owners Concierge customer in good standing at that time. Referred customers must purchase a minimum of one monthly package. Trial subscriptions that offer packages at low or no cost are eligible only once the trial period is complete and purchase made. Credit will be applied 60 days from date of sign up if, at that time, both referring and referred customers are both current Owners Concierge customers in good standing. Limit of 1 (one) credit per each unique referred customer.
CasualRental.com Participants
The Owners Concierge System is designed to facilitate a complete vacation experience and can assist you self-manage your private casual rental. All package subscriptions include access to tools and forms to create an attractive rental home profile in six easy steps. You remain in control and set the terms and conditions as well as set rates and policies for rental guests. OwnersConcierge may offer only the limited editing services of proofreading for spelling and grammar at your request. You may opt to share your casual rental profile on casualrentals.com for no additional charge. You may direct promotion from your Owners Concierge member dashboard.
Private Party Transactions
OwnersConcierge does not provide current or historical information concerning real property, market trends or valuations nor does it represent itself as a real property agent or broker. The Owners Concierge System uses remote database technology to provide tools and services to clients through a Virtual Office System. The system allows technology assists homeowners who self-manage their casual rental.
Creating Rental Profile – Optional
Owners Concierge is not a rental company. The Owners Concierge System facilitates a complete vacation experience for members and provides access to tools and services to assist members self-manage their private casual rental. Each member sets the terms and conditions of their private rental as well as determines rates and other conditions. Payment methods and options, Refund and Cancellation policies and any additional terms vary by owner. You are responsible for reviewing the requirements, conditions and terms set out in member property profiles.
Peer-to-Peer Transactions
Each listing member determines their specific terms, conditions and policies and sets their own rates. You must review the property details for payment methods, Refund and Cancellation policies and any additional terms. For all inquiries about a specific property and to confirm your request dates you must contact the owner directly through your Travelers’ Account. While CasualRentals.com by Owners Concierge® offers tools to enable remote peer-to-peer private rentals, it is your responsibility to resolve any issues that may arise with the owner directly through your Travelers’ Account.
Escrow
To make online bookings and payments between members more safe and secure the Owners Concierge system provides an integrated escrow solution for a small service fee. The escrow discount is the percent of total transaction required to reserve your requested dates as set by the member. To promote clarity and transparency, and this information can be found in the rental profile for that particular property. Cancelation policies vary by each member. Some may detail a time period during which you may cancel for a full or partial return of held monies. In the event you are entitled to returned funds, the service fee will not exceed 4% of monies held. You are responsible for understanding the member’s terms, conditions, rules, rates and policies.
Vacation Certified Eligible
Owners Concierge has designed a specific set of guidelines and standards for service and comfort that enhance any vacation experience. Packages that meet these standards are denoted as Vacation Certified Eligible. Customers of an eligible package may have their home reviewed as Vacation Certified™ by Owners Concierge® so long as it continues to qualify and the member remains in good standing. Vacation Certified does not ensure the experience will be free from defect and risks and is not a guarranty or assumption of liability. Customers may refer to their service agreement or request a copy through an Owners Concierge® Team member here<www.ownersconcierge.com/contactus>. Specific legal questions should always be directed to a licensed attorney.
Disputes
Members may not file a complaint with one of our payment procssors, including PayPal, regarding the funds deposited into their account. Owners Concierge staff will do its best to resolve any problem a member may have. Refunds will be processed, if deemed necessary, at a time of Owners Concierge staff’s choosing. Due to the incompatable communication systems between our payment processors and Owners Concierge staff members, payment disputes logged directly with those processors cannot be properly managed and will cause further delays. For this reason, members who make complaints to our payment processor can face account termination without notice. Owners Concierge makes available a member dispute system that may be used by members to request mediation by staff. Owners Concierge reserves the right to use its own discretion to make decision in favor of a party and considers its decision final. A fee may be charged to reopen closed dispute cases.
E-mail Addresses
Members agree not to post their e-mail address on the site, except in the “e-mail” field of the signup form, or when asked by OwnersConcierge at any other time. There is simply no good reason for you to broadcast your private information across the internet. You will be able to receive and respond to inqueries from your member dashboard.
Modifications
Owners Concierge reserves the right to change the member Terms and Conditions at any time. It is the member’s responsibility to check these Terms and Conditions from time to time for such changes. In the event Owners Concierge offers any additional or replacement services then this agreement shall apply to such services in the absence of any new agreement specific to such services which is entered into between the parties.
Ownership
Members agree that all information contained on a website operated by Owners Concierge, and all information compiled by Owners Concierge through operation of affiliate program, is the proprietary information of Owners Concierge. Personal information provided by members will be kept confidential and will not be distributed to any third party.
The Role of Owners Concierge
Owners Concierge bridges the gap between value and service, facilitating the technology and tools that allow members to enjoy self-managing their own casual rental without compromising the vacation experience of guests.
Accounts
An individual may not possess more than one Owners Account and one Travelers Account, unless they have contacted and received authorization from Owners Concierge staff. Users found with unathourized multiple accounts, or found to be using multiple accounts to avoid fees, payments, removal or other limitations, will face suspension of all their accounts. It is prohibited under all cercustances to transfer ownership of an account, without authorization from Owners Concierge staff. Accounts that are inactive (have no login activity) for more than 12 months will be deactivated and have their remaining funds deducted by Owners Concierge.
